1. ACCEPTANCE OF TERMS

C. Account Termination:

• You may delete your account at any time through the app settings
• We reserve the right to suspend or terminate accounts that violate these Terms
• Upon account deletion, all your data will be permanently erased

4. DESCRIPTION OF SERVICE

Orali AI is an AI-powered conversational language learning application that:

• Provides interactive language practice through voice conversations
• Converts your speech to text for AI processing
• Offers personalized learning experiences
• Tracks your progress and conversation history

The App uses artificial intelligence to simulate natural conversations and help you improve your language skills.

5. USER CONDUCT AND ACCEPTABLE USE

When using Orali AI, you agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the App or our systems
• Interfere with or disrupt the App's functionality or servers
• Use the App to harass, abuse, or harm others
• Upload or transmit viruses, malware, or malicious code
• Attempt to reverse engineer, decompile, or extract source code from the App
• Use automated systems (bots, scripts) to access the App
• Violate any applicable laws or regulations
• Impersonate any person or entity
• Share your account with others

6. INTELLECTUAL PROPERTY RIGHTS

A. Our Rights:

• The App and all its content, features, and functionality are owned by OraliAI Inc
• This includes but is not limited to: software, text, graphics, logos, images, and AI models
• The App is protected by copyright, trademark, and other intellectual property laws
• "Orali AI" and our logo are trademarks of OraliAI Inc

B. Your License:

• We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial language learning purposes
• This license is restricted to Apple devices that you own or control
• You may not copy, modify, distribute, sell, or lease any part of the App

C. Your Content & Audio:

• You retain ownership of the conversation content you create through the App
• By using the App, you grant us a limited license to use your audio recordings solely to train and improve our AI language teaching model — for no other purpose
• We will never use your audio for advertising, sell it to third parties, or apply it to any purpose outside of improving Orali's teaching quality
• We will only use your data as described in our Privacy Policy

7. SUBSCRIPTIONS AND PAYMENTS

A. Subscription Plans:

• Orali AI may offer various subscription plans with different features
• Subscription fees are charged through the Apple App Store
• All payments are processed by Apple and our payment partner RevenueCat

B. Billing:

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You will be charged through your Apple ID account
• Manage subscriptions through your Apple ID settings

C. Refunds:

• Refund requests must be made through Apple's App Store
• We do not have access to process refunds directly
• Contact Apple Support for refund inquiries

D. Changes to Pricing:

• We reserve the right to modify subscription prices
• Price changes will not affect your current subscription period
• You will be notified of price changes before they take effect

8. PRIVACY AND DATA COLLECTION

9. DISCLAIMERS AND LIMITATIONS OF LIABILITY

A. Service "As Is":

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

B. No Guarantee of Results:

• We do not guarantee that using Orali AI will result in language fluency or specific learning outcomes
• Language learning requires consistent effort and practice
• Results vary by individual

C. AI Limitations:

• Our AI is designed to assist with language learning but may occasionally provide inaccurate or inappropriate responses
• The AI should not be considered a substitute for professional language instruction
• You should not rely solely on the App for critical communication needs

D. Service Availability:

• We do not guarantee uninterrupted or error-free service
• The App may be unavailable due to maintenance, updates, or technical issues
• We reserve the right to modify or discontinue features at any time

E. Limitation of Liability:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORALIAI INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers or your personal information
• Any bugs, viruses, or malicious code transmitted through the App
• Any errors or omissions in content or for any loss or damage incurred from using the App

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless OraliAI Inc, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations

11. MODIFICATIONS TO THE SERVICE AND TERMS

14. APPLE-SPECIFIC TERMS

• OraliAI Inc, not Apple, is solely responsible for the App and its content

B. Scope of License:

The license granted to you is limited to a non-transferable license to use the App on any Apple device that you own or control as permitted by the App Store Terms of Service.

C. Maintenance and Support:

• OraliAI Inc is solely responsible for providing maintenance and support services
• Apple has no obligation to furnish any maintenance or support services

D. Warranty:

• OraliAI Inc is solely responsible for any product warranties
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you
• Apple has no other warranty obligation whatsoever with respect to the App

E. Product Claims:

OraliAI Inc, not Apple, is responsible for addressing any claims relating to the App or your use of it, including:

• Claims that the App fails to conform to any applicable legal or regulatory requirement
• Claims arising under consumer protection or similar legislation

F. Intellectual Property Claims:

OraliAI Inc is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim.

G. Third-Party Beneficiary:

• Apple and its subsidiaries are third-party beneficiaries of these Terms
• Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary

H. Legal Compliance:

You represent and warrant that:

• You are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country
• You are not listed on any U.S. Government list of prohibited or restricted parties

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OraliAI Inc regarding the App.
